SCHOOL SITE COUNCIL (SSC)

BY-LAWS & MISSION STATEMENT

2021/22

We, the staff, parents, and community of Kimbrough Elementary School, are committed to: Providing a safe and caring environment where all children are given the opportunity to grow in knowledge, responsibility, and self-esteem; and to experience a love of learning. Our common goal is to provide our students with future life skills for success in a diverse society.

ARTICLE I

  1. NAME OF COUNCIL
  2. The name of this council will be the Kimbrough School Site Council (SSC).

  3. DUTIES OF THE SCHOOL SITE COUNCIL
  4. The Kimbrough School Site Council will be empowered to make recommendations and decisions. It will carry out all duties and responsibilities assigned to it in the Education Code of the State of California. Education Code Sections 52034, 52855, 54722 assign the SSC the responsibility for developing the school plan.

    • Obtain recommendations for, and review of, the proposed Single Plan for Student Achievement (SPSA) from all school advisory committees.

    • Develop and approve the SPSA and related categorical expenditures in accordance with all state and federal law and district regulations.

    • Recommend the SPSA and categorical expenditures to the SDUSD Board of Education for approval.

    • Provide ongoing review of the implementation of the SPSA with the principal, teachers, and other school staff members.

    • Make modifications to the SPSA whenever the need arises.

    • Submit the modified SPSA for district approval whenever a material change (as defined in district governing board policy) is made in planned activities or related categorical expenditures.

    • Regularly evaluate the progress made toward school goals to raise the academic achievement of all students.

    • Carry out all other duties assigned to the council by the SDUSD Board of Education and by state law.

ARTICLE II

MEMBERS

  1. Size and Composition
  2. The Kimbrough School Site Council will be composed of 10 members as follows.

    The needs and resources of the school improvement program require that membership include broad representation of parents and staff, including all socio-economic and ethnic groups represented in the school attendance area. Representation on the School Site Council will be: The principal, representatives of classroom teachers selected by classroom teachers at the school, other school personnel selected by other school personnel at the school, parents of pupils attending the school selected by such parents.

    The council shall be composed of 10 members, selected by their peers, as follows:

    • (1) PRINCIPAL

    • (3) CLASSROOM TEACHER

    • (1) OTHER SCHOOL STAFF

    • (5) PARENTS OR COMMUNITY MEMBERS

    The school principal shall be an ex officio member of the council. The principal or his/her designee shall attend all SSC meetings; however, only the principal may vote on actions. Council members chosen to represent parents may be employees of the school district so long as they are not employed at this school.

  3. Term of Office
  4. Council members of the School Site Council will serve a two-year term or the nearest approximation thereof, of each representative group shall be elected during odd years, and the remaining number of elected members during even years. At the first regular meeting of the council, each member's current term of office shall be recorded in the minutes of the meeting.

  5. Voting Rights
  6. Each member of the council is entitled to one vote and may cast that vote on any matter submitted to a vote of the council.

    Absentee (proxy) and any electronic ballots shall not be permitted.

  7. Termination of Membership
  8. A member will no longer hold membership should he/she cease to be a resident of the area or no longer meets the membership requirements under which he/she was selected (e.g. a parent becomes employed by the district). Membership will automatically terminate for any member who is absent from all regular meetings for a period of three consecutive months. The School Site Council can suspend or expel a member by a vote of 50% plus one of all the members.

  9. Transfer of Membership
  10. Membership in the Kimbrough School Site Council is not transferable or assignable.

  11. Resignations
  12. Any member may resign by filing a written resignation with the Kimbrough School Site Council.

  13. Vacancy

Any vacancy on the School Site Council will be filled for the remainder of the school year by appointment by the chairperson. If the unexpired term is for another full year thereafter, the term for that year will be filled by the regular selection process.

ARTICLE III

ELECTIONS OF COUNCIL MEMBERS

  • The school principal is a standing member of the council.
  • Classroom teacher elections will be held in September:

- The classroom teacher membership will be elected into rotational positions of two years.

- Nominations and elections are conducted by classroom teachers.

- If there are fewer or equal nominees than there are positions vacant, the nominees will automatically be accepted as representatives.

  • "Other" staff elections will be held in September.

- The "other" staff membership will be elected into rotational positions of two years.

- Nominations and elections are conducted by "other" school personnel.

- If there are fewer or equal nominees than there are positions vacant, the nominees will automatically be accepted as representatives.

  • Parent/Community Member representative elections will be conducted in September.

- Nominations and elections will be conducted by the school office staff.

- Announcement of the nominations will be included in the May, June, and

September issues of the school newsletter, or website. The announcement will also

be posted on the School Marquee.

- Nominations will be accepted in September.

- If there are fewer or equal nominees than there are positions vacant, the nominees will automatically be accepted as representatives.

All election ballots and result records will be maintained at the school site for seven (7) years.

ARTICLE IV

OFFICERS

  1. Officers

The officers of the Kimbrough School Site Council will be a chairperson, co-chairperson, recorder, and such other officers as the School Site Council may deem desirable.

The chairman shall:

  • Collaborate with the principal in developing agendas and reviewing minutes prior to posting.

  • Preside at all meetings of the council.

  • Sign all letters, reports, and other communications of the council.

  • Perform all duties incident to the office of the chairman.

  • Have other such duties as are prescribed by the council.

The vice-chairman shall:

  • Represent the chairman in assigned duties.

  • Substitute for the chairman in his/her absence.

The secretary shall:

  • Keep minutes of all regular and special meetings of the council.

  • Transmit true and correct copies of the minutes of such meetings to members of the council.

  • Provide all notices in accordance with these bylaws.

  • Keep a register of the names, addresses, and telephone numbers of each member of the council, the chairmen of school advisory committees, and others with whom the council has regular dealings, as furnished by those persons.

  • Perform other such duties as are assigned by the chairman or the council.

  • Election and Term of Officers
  • The officers of the Kimbrough School Site Council will be elected annually and will serve for one year or until each successor has been elected.

  • Removal
  • Any officer may be removed by a 50% plus one vote of all members sitting on the Kimbrough School Site Council whenever, in the judgment of the School Site Council, the best interests of the School Site Council would be served thereby.

  • Vacancy
  • A vacancy in any office because of death, resignation, removal, disqualification, or otherwise will be filled by the School Site Council by special election for the unexpired portion of the term.

    ARTICLE V

    Committees

    1. Sub-committees
    2. The council may establish and abolish sub-committees of their own membership to perform duties as shall be prescribed by the council. At least one member representing teachers and one member representing parents shall make up the sub-committee. No sub-committee may exercise the authority of the council.

    3. Other Standing and Special Committees
    4. The council may establish and abolish standing or special committees with such composition and to perform such duties as shall be prescribed by the council. No such committee may exercise the authority of the council.

    5. Terms of Office
    6. The council shall determine the terms of office for members of a committee.

    7. Rules
    8. Each committee may adopt rules for its own government not inconsistent with these bylaws or rules adopted by the council, or policies of the district governing board.

    9. Quorum

    A majority (51% or greater) of the members of the committee shall constitute a quorum, unless otherwise determined by the council. The act of a majority of the members present shall be the act of the committee, provided a quorum is present

    ARTICLE VI

    MEETING OF THE KIMBROUGH SCHOOL SITE COUNCIL

    1. Regular Meetings
    2. The Kimbrough School Site Council will meet once a month at 2:30 p.m. as the school calendar allows or a minimum of eight times per school year. The council shall meet regularly on the 4th Monday of each month. Special meetings may be called by the Chairperson or majority vote of the Kimbrough School Site Council.

    3. Place of Meetings
    4. The Kimbrough School Site Council will hold its regular monthly meetings and special meetings in a facility provided by the school and readily accessible by all members of the public, including handicapped persons. Alternate meeting places may be determined by the chairman or by majority vote of the council.

    5. Notice of Meetings
    6. Notices of the meetings will be posted at the school site 24 hours prior to the meeting. The notices will specify the time, date and location of the meeting, and an agenda describing each act of business to be discussed or acted upon.

      1. Written public notice of all meetings shall be given at least 72 hours in advance of the meeting.
      2. Changes in the established date, time, or location shall be given special notice.
      3. All meetings shall be publicized in the following venues newsletter and bulletin board.
      4. All required notices shall be delivered to council and committee members no less than 72 hours, personally, or by mail or via e-mail.
    7. Posting of Minutes
    8. Agenda items and decisions of the Kimbrough School Site Council will be reported on the Kimbrough webpage. Drafts of the minutes will be posted in the parent room, staff lounge, workroom, and front desk.

    9. Quorum
    10. The presence of 50% plus one of the total membership will be required in order to constitute a quorum necessary for the transaction of the business of the Kimbrough School Site Council. The act of the majority of the members present shall be the act of the council, provided a quorum is in attendance, and no decision may otherwise be attributed to the council. A majority of the members of the council (51% or greater) shall constitute a quorum. No actions may be taken unless a quorum has been established.

    11. Conduct of Meetings
    12. Meetings of the council shall be conducted in accordance with the rules of order established by California Education Code Section 35147 (c) and with Robert's Rules of Order or an adaptation thereof approved by the council.

    13. Meetings Open to the Public

    All meetings of the council, and of committees established by the council, shall be open to the public.

    Any person who wishes to address the School Site Council needs to be on the agenda.

    ARTICLE VII

    Amendments

    An amendment of these Bylaws may be made at any regular meeting of the council by a vote of two-thirds (2/3) of the members present. Written notice of the proposed amendment must be submitted to council members at least three (3) days prior to the meeting at which the amendment is to be considered for adoption.
